2018 Terms and Conditions

MEMBERSHIP/ACCESS ENTITLEMENTS

All 2018 AFL Memberships are subject to the following terms and conditions.

1.  Purchase of membership

If you are successful in your AFL Membership application, the AFL will send you an email confirmation within 7 working days. A 2018 membership card and/or package will be sent by mail prior to the commencement of the 2018 pre-season competition if your application is received prior to Wednesday January 31, 2018. After this date, membership cards and/or packages should be received approximately 14 days after the date on which the AFL receives your application.

2018 Membership renewal applications received after Wednesday January 31, 2018 will be subject to a late fee of $25 for Adults and $10 for Juniors.

The AFL reserves its right to not accept a Membership application at any time in its absolute discretion.

2. Term of Membership

Subject to the following terms and conditions, your AFL Membership benefits will be available to you from the date of your first Membership payment to Wednesday October 31, 2018.

3.   Access Entitlements

3.1   2018 NAB Challenge: 2018 JLT Community Series (Preseason competition): All AFL Members will have access* to all matches during the 2018 JLT Community Series competition.

3.2   2018 Toyota AFL Premiership Season: Except where stated otherwise, all Members will have access* to up to 40 matches in any combination at the MCG and Etihad Stadium throughout the Toyota AFL Premiership Season. Due to demand, the Collingwood v Essendon ANZAC Day match is classified as a ‘reserved seat ticket’ event. AFL Members wishing to attend this match will be required to pay for a reserved seat and general admission access will not be available..

3.3   2018 Toyota AFL Finals Series Weeks 1 and 2: Except where stated otherwise, all Members will have access* to matches scheduled at the MCG and Etihad Stadium in weeks 1 and 2 of the Toyota AFL Finals Series. The AFL makes no representation or guarantee that there will be any match scheduled at the MCG or Etihad Stadium in either of weeks 1 and 2 of the Toyota AFL Finals Series. Members will be provided with further information regarding Toyota AFL Finals Series tickets in August 2018.

3.4  2018 Toyota AFL Finals Series Week 3:  AFL Gold Members will have Access* to all Week 3 matches scheduled at the MCG and Etihad Stadium (and other venues, where their club of support is playing at those venues). AFL Silver Members will have Access^ to purchase a ticket to Week 3 matches scheduled at the MCG and Etihad Stadium and may purchase guest passes to Week 3 matches where the AFL makes them available.

3.5   2018 Toyota AFL Grand Final: Tickets to the 2018 Toyota AFL Grand Final will be made available to AFL Members in the following order of priority:

3.5.1   Priority Access^ to Gold Members who have nominated a club of support as part of their AFL Membership and is participating in the Grand Final (Grand Final Team Club Support).

3.5.2   Second Access^ to Gold Members who do not have a Grand Final Team Club Support (subject to tickets being available after the Priority Access period).

3.5.3   Third Access^ to Silver Members who have a Grand Final Team Club Support (subject to tickets being available after the Second Access period).

3.5.4   Fourth Access^ to Silver Members who do not have a Grand Final Team Club Support (subject to tickets being available after the Third Access period).

3.6   Cricket: Members will have access to International Cricket Test, Twenty20 and One Day International matches scheduled at the MCG (excluding Big Bash League matches). Tickets can be obtained only by reservation and are limited to one ticket per Member per match. Reservation fees apply. Additional guest passes may be purchased at the same price as tickets available to the public.

4.    Applicable Venues

AFL Membership access is limited to matches at the MCG and Etihad Stadium. Access to other venues will vary across clubs and will be communicated via membership.afl.com.au.

5.   General Stadium Rules

AFL Members must adhere to the AFL’s Conditions of Entry into an AFL Venue, and must adhere to any further rules and restrictions imposed by the MCG and Etihad Stadium (or any other venue attended by the AFL Member). All AFL venues are smoke-free. Patrons are not permitted to bring alcohol into any venue and must adhere to strict restrictions placed on alcohol consumption in designated areas at all venues. Umbrellas are not permitted to be opened anywhere within viewing areas at any time on match day.

6.   Saving Seats in the AFL Reserve

AFL Members are not permitted to save seats for latecomers. Attendants are authorised to remove items used to save seats. AFL Members must respect the temporary reservation of a seat should a Member who has entered the ground wish to vacate their seat briefly.

7.   MCG Crossovers

Crossover access into the public section of the MCG during the  MCC and subject to change on match day.
Crossovers into the public section is available during International Cricket matches.

8. Guest Passes

The AFL may make Guest Passes available for sale to AFL Members. Guest Passes will be sold on a first-come, first served basis until sold out. AFL Members are advised to pre-purchase Guest Passes, particularly for high demand matches. Subject to availability, Guest Passes may be made available for sale at the gate on match day.

The standard limit on the number of Guest Passes is four per Member at the MCG and two per Member at Etihad Stadium for Toyota AFL Premiership Season matches, and one per Member at the MCG and at Etihad Stadium for Toyota AFL Finals Series matches (Weeks 1-3). The AFL reserves the right to vary the number of Guest Passes available to each Member at each venue as well as the total guest pass allocation. Once guest passes have been purchased, no refunds will apply except as required by law.

Guest Passes will not be available for the Collingwood v Essendon ANZAC Day match or the AFL Grand Final. Etihad Stadium Level 1 Guest Passes will not be available for matches featuring Essendon or Collingwood and further Guest Pass restrictions will be determined for high demand matches.

9.  AFL Membership Cards

AFL Members are required to carry their Membership card with them when attending a match, including when a reserved seat has been pre-purchased. AFL Members who do not carry their card with them when attending a match may be required to pay an entrance fee at the same price as an AFL Members Guest Pass.

9.1.  Lost or Stolen Memberships Cards

A Member who loses an AFL Membership card will be provided with a new card upon providing the AFL with a statutory declaration stating that the card has been misplaced and upon payment of a card replacement fee of $5. The card will be replaced at no cost upon provision of a police report detailing the theft.

10.  No Resale

AFL Membership cards, AFL Reserve tickets and Guest Passes may not, without the prior written consent of the AFL, be resold or offered for resale at a premium (including via on-line auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original purchaser or any subsequent bearer. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the bearer of the ticket may be refused admission. Penalties apply (including cancellation of any offending member’s AFL Membership without a refund).

Scalping warning: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties. The AFL Grand Final is a Declared Event under the provisions of the Major Sporting Events Act 2009 (Vic), a breach of which may be an indictable offence and allows your ticket to be cancelled.

11.  Club Support Packages

11.1. AFL Members may nominate a club of support as part of their AFL Membership application or renewal (Club Support Package). Your Club Support Package covers the cost of entry for your club’s home matches. Your club (or your club’s home venue(s)) will determine seating requirements and may require you to reserve a seat at an additional cost (either seasonally through your club of support or for individual matches through a nominated ticket agency).

11.2. Unless you advise otherwise in your Membership application or renewal, by nominating a club of support you are agreeing to your personal details being forwarded to the club so that it may contact you for club or commercial purposes, including fulfilment packs, upgrade products and finals access. Members will not be able to change their nominated club of support after Friday March 30, 2018, but may opt out of receiving that club’s communications at any time.

12.  Cancellation Policy 

The AFL reserves its right to cancel a member’s AFL Membership without a refund where that member is deemed by the AFL to have breached these terms and conditions (including where that member attempts to transfer or sell their AFL Membership and/or associated benefits).

13.  Variation to AFL Membership Terms and Conditions

The AFL may from time to time where reasonably necessary vary the terms and conditions of AFL Membership. The AFL will communicate any change to the terms and conditions of AFL Membership via the membership.afl.com.au. Members will have no claim against the AFL for any change made to the terms and conditions of AFL Membership.

14. AFL Member Code of Conduct

While barracking and supporting your club is a vital part of the game, offensive or aggressive behavior (including yelling and swearing when dealing with AFL staff, agents or event staff) will not be tolerated. AFL Members who consume alcohol on a match day are to do so responsibly. Drunkenness will not be tolerated. AFL Members who breach the behaviour code of conduct may face penalties including cancellation of Membership without refund. The AFL has a strong stance on vilification and has a zero-tolerance for members or supporters who engage in conduct which may reasonably be considered to incite hatred towards, contempt for, ridicule of or discrimination against a person or group of persons (including the opposition, opposition supporters, or umpires) on the ground of their race, religion, gender, colour, sexual preference, orientation or identity, or special ability or disability.

15.  Dress Standards

Dining rooms in the AFL Reserve at the MCG and Etihad Stadium maintain dress standards. The dress standard is neat casual - thongs, shorts and singlets are not permitted. Appropriate attire is also required in all seating areas. AFL Members who are not dressed appropriately will be denied entry.

16.  No Voting Rights

AFL Membership does not grant AFL members any voting rights.

17.  Members Privacy

All personal information will be used, and may be disclosed, by the AFL (including for promotional and marketing purposes) in accordance with the AFL Privacy Policy available at www.afl.com.au/privacy.  By providing your personal information you agree to such use and disclosure by the AFL and confirm you have read and agree to be bound by the AFL Privacy Policy.

CLASSIFICATIONS

All 2018 AFL Memberships are subject to the following terms and conditions

19.      MEMBERSHIP TYPES 

19.1.   Gold Membership: Gold Membership is the highest level of AFL Membership, capped at 31,000 Members and available for purchase only to existing Gold Members. The AFL will offer Gold Membership to selected Silver Members for an upgrade to Gold Membership each season, with the number of offers dependent on the retention of current Gold Members. Gold members must renew their membership prior to Thursday, 31 May 2018  to maintain their Gold membership entitlements for 2018 season.

19.2.   Silver Membership: Silver Membership is available to all current AFL Members and, subject to availability, members of the general public seeking to purchase AFL Silver Membership for the first time. New Silver Memberships are subject to a once off joining fee.

19.3. Bronze Membership: Bronze Membership is available to all current AFL Members and, subject to availability, members of the general public.

19.3.1. Access* up to 10 matches at the MCG through the 2018 Toyota AFL Premiership Season. Plus access* to the 2018 Toyota AFL Finals Series weeks 1 -2 at the MCG at Guest Pass Price, if guest passes are available. 

19.4.   Family: To be eligible for a family discount, there must be two full paying Gold, Silver or Bronze adult members (adult members with no concessions or discounted members) and one full fee-paying junior or student member and reside at the same residential address. Any additional juniors will be provided with a complimentary Membership upon payment of the new member fee if joining AFL Membership in 2018. No more than four juniors can be linked to one family for the purposes of this discount. The junior or student with the highest value Membership type will be required to pay the annual Membership fee.

19.5. Junior 

To be eligible for a Junior Membership, the applicant must be over the age of 6 and under the age of 17 as at January 1, 2018. Juniors aged 6 and under at January 1, 2018 can purchase an AFL Under 7 Membership. Juniors aged 5 and under do not require an AFL Membership, however they cannot access a seat at matches unless there are seats available in the AFL Reserve which have not been reserved. Only children aged 3 and under are entitled to access Toyota AFL Finals Series matches free of charge, however they must not occupy a seat.

19.6. Under 7
An Under 7 Membership is available for children under the age of 7 as at January 1, 2018. A one-off new member fee is payable on sign up and the membership will continue to be complimentary until the Under 7 member reaches Junior member statues (see point 18.5). Upon becoming an Under 7 Member, your child will be placed on the waiting list for Gold Membership and receive an annual Under 7 Membership, allowing them to purchase reserved seating in the AFL Reserve at the MCG and Etihad Stadium (subject to capacity). An Under 7 Membership provides access equivalent to an AFL Silver Membership, excluding club of support entitlement.

19.7. Country 
Gold Members living more than 180km (as determined in accordance with Australia Post postcode data) from the Melbourne CBD are eligible for Country concession. When first applying for country concession, you will need to supply a statutory declaration, together with proof of residency (for example, a copy of your driver’s licence) to verify your address. When renewing a country concession, Gold Members will be required to verify their country residential status each renewal period by submitting proof of residency with their renewal application. In all cases, PO Box addresses will not be accepted without supporting documentation.

19.8. Absentee
An Absentee Membership allows you to place your Membership on hold for a season (or multiple seasons if the annual fee for Absentee Membership is maintained) and allows you to return to the same Membership status and number when your circumstances change. Gold and Silver Members may obtain an Absentee Membership for an annual fee of $150 (inc GST) for adults and $75 (inc GST) for juniors and upon provision of a letter or email (accompanying your renewal application) which outlines your Absentee status.

 

CONCESSION

All 2018 AFL Memberships are subject to the following terms and conditions.

20. Concession Membership
Any member eligible for or considering a concession membership must provide a copy of their concession at the point of purchase. Please email a photograph or scanned copy of your valid concession through membership@afl.com.au.

20.1. Student Concession 

 Student concession is available to students studying full-time in 2018 at an Australian Education Institution. Your Membership application/renewal form must be accompanied by a copy of your 2018 student card or a photocopy of a stamped, receipted 2018 enrolment form from your Australian Education Institution.

Student cards provided must have a visible and valid expiry date to be accepted. All enrolment forms must show full-time enrolment for both Semester 1 and 2 in 2018.

As a student, you may defer your payment until 31 March 2018. If you choose to do this, you will be unable to utilise any of your Membership benefits until payment is made. Please contact the AFL Membership Service Centre on 1300 722 515 should you wish to defer payment. Students who renew their Membership at the Adult rate will be required to lodge their student concession request by close of business on Thursday May 31, 2018 to obtain the appropriate refund. Refund requests received after this time will not be accepted.

Students applying for concession membership after close of business Thursday May 31, 2018 must provide enrolment forms stating full-time status for both semesters 1 & 2. Student cards will not be accepted after this date.

20.2. Concession/Pensioner
Concession discounts apply to members holding the following pension/concession cards:

  • Centrelink
  • Department of Health and Community Services
  • Department of Community Services
  • Department of Veteran Affairs

A photocopy of your pension/concession card must accompany your 2018 renewal. Pension/concession cards must be valid for the duration of the 2018 Toyota AFL Premiership Season.
Dependents listed on the pension card are NOT eligible for a concession membership unless they hold their own pension/concession card. 

Concession/Pensioner who renew their Membership at the Adult rate will be required to lodge their concession request by close of business on Thursday May 31, 2018 to obtain the appropriate refund. Refund requests and proof of concession received after this time will not be accepted.

AFL ADVANCE EASY PAY

All 2018 AFL Memberships are subject to the following terms and conditions.

Payment of your AFL Membership fee may be made in one of two ways:

21. Full Payment: Your Membership fee can be paid via any one of the following methods: VISA, MasterCard, Australia Post Billpay, Cheque, Cash or EFTPOS.

21.1. Payment Plan: Except where otherwise stated, your Membership payments via a payment plan as follows:

21.2.    AFL Advance Easy Pay monthly payments will be deducted in 10 equal instalments on the 28th of each month, beginning on November 28, 2017 via a nominated VISA or MasterCard only.

21.2.1.  By signing with the AFL Advance Easy Pay payment plan you authorise the AFL to arrange a debit of funds from your nominated credit card in amounts and at intervals as advised.

21.2.3.    All members on the AFL Advance Easy Pay payment plan are automatically included into an Auto Renewal Agreement, facilitating automatic rollover of your memberships from year to year.

21.2.4.   Members can only opt out of the AFL Advance payment plan after the last instalment and prior to the first instalment for the following season by notifying the AFL either in writing or via email to membership@afl.com.au. All outstanding payments must be complete at time of opting out.

21.2.5.   Members will be given at least 14 days’ notice in writing of changes in the new amount of their next season's membership and to the terms of AFL Advance Easy Pay payment plan agreement.

21.2.6.    The first instalment will be withdrawn on November 28, 2017, with further payments on the 28th of each following month. If any payment fails to transfer between institutions on the 28th, further attempts will be made to attempt to clear the fund transfer. If the 28th of the month falls on a weekend, the payment will be withdrawn on the next business day.

21.2.7.    Members applying for the AFL Advance Easy Pay payment plan after the first scheduled payment will have the number of required payments deducted to bring them up to date with the schedule and then subsequent payments at each specified date.

21.2.8.   If your debit is returned or dishonoured by your financial institution, a letter will be sent requesting immediate payment. Any fees levied to you by your financial institution will be payable to you.

21.2.9.    The AFL may suspend or cancel your membership if, on two consecutive occasions, payment is dishonoured by your financial institution.

21.2.10.  It is your responsibility to ensure that: (a) the account details you have provided are correct, including notification should the expiry date change within the 10-month program; (b) you have sufficient clear funds available in the nominated account on the scheduled drawing date.

21.2.11.  If your Membership is suspended or cancelled, you will not be able to gain access to any matches during the Premiership Season or the Toyota AFL Finals Series.

21.2.12.  If you believe that a withdrawal has been initiated incorrectly, please contact the AFL Membership Service Centre on 1300 722 515. You will receive a full refund of the withdrawal amount if we cannot substantiate the reason for drawing.

21.2.13. All AFL Advance Easy Pay monthly instalments are subject to $10 administration fee and will be charged within 3 working days of the initial payment on November 28, 2017. If the Member signs up after November 28 2017, the $10 administration fee will be charged within 3 working days of the next scheduled instalment. If the administration fee payment fails to transfer between institutions, further attempts will be made to attempt to clear the fund transfer. 

22.  GST and Levies

Except where expressly noted, all prices include GST and the $12 MCG levy (which applies to adults, pensioners and students).

* Access to matches is not guaranteed. Access is subject to capacity and the AFL recommends that Members reserve a seat in order to guarantee entry, particularly at high demand matches. AFL Members will be required to pay additional fees and charges when reserving a seat and ticket agencies may charge a booking fee which is also to be covered by the Member. For any match other than the Collingwood v Essendon ANZAC Day match, access may be gained to designated unreserved seating on a first-come, first served basis subject to availability and Members can upgrade to a reserved seat at the venue for an additional fee subject to availability.

^ Access to purchase tickets at an additional cost. Availability is subject to capacity and is not guaranteed. Ticket agencies may charge a booking fee upon purchase of tickets, with such fees to be covered by the Member.

 

UNDER 7 FOOTBALL EXPERIENCE

AFL MEMBERSHIP UNDER 7 JUNIOR MEMBER ULTIMATE FOOTBALL EXPERIENCE 

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Conditions of Entry. Participation in this competition is deemed acceptance of these Terms and Conditions.

2. Entry is open to Australian residents who reside in Victoria and are an ‘AFL Under 7 Member’ (“Eligible Entrants”). All entrants must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this competition.

3. Employees (and their immediate families) of the Promoter, participating outlets and the agencies associated with this promotion are ineligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse child or step-child (whether natural or by adoption), parent, step-parent.

4. Competition commences on 01/01/18 at 12:01am AEDST and closes 30/04/18 at 11:59pm AEST (the “Competition Period”).

5. To enter this competition, Eligible Entrants must during the Competition Period complete and submit a drawing of their ’favourite footy moment’, by posting their drawing to AFL, GPO Box 5275, Melbourne VIC 3001, detailing their full name, email address, contact phone number and team of support.

6. The Promoter reserves the right, at any time, to invalidate any entries (and entrants who submit or cause those entries to be submitted) which it reasonably suspects have been submitted: (a) using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information; (b) through the use of multiple identities, email addresses or accounts; and/or (c) in any way in contravention of these Terms and Conditions

7. Incomplete, illegible or incorrect entries, or those which contain offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, will be deemed invalid.

8. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.

9. The Promoter reserves the right, at any time during, or after the closing date of the competition, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

10.  Entries are deemed to be received at the time of receipt into the Promoter’s competition database and NOT at the time of completion by the Eligible Entrant. Any cost associated with entering the competition is the Eligible Entrant’s responsibility.

11. The judging will take place at AFL House, 140 Harbour Esplanade, 3008 on 01/05/18 at 11:00am. The prize winners will be notified via phone call and/or email within two (2) days of the selection to organise the claiming of their prize. The Judges' decision is final and no correspondence will be entered into. The winners’ names will be published on the AFL Membership Facebook page and membership.afl.com.au from the day that the prize winner is selected.

12. This is a contest of skill, judged on criteria set by the AFL. Chance will not play a role in determining the Competition winner.

13. The most creative drawing will win one (1) x Ultimate Football Experience valued at approximately $400.  The prize includes:

  • Free reserved seat upgrade for the winner plus three (3) guests to an  AFL match of their choice at Etihad Stadium during the 2018 AFL Premiership Season
  • Complimentary dining in the AFL Members Lounge in Victory Room at Etihad Stadium for the winner plus three (3) guests to the same match chosen in the point above in 2018 AFL Premiership Season
  • Tour of AFL House at a time determined by the AFL
  • Photo with the Premiership Cup
  • Access to the post-match press conference room
  • Photo opportunity in the centre of Etihad Stadium
  • Watch teams warm up from the boundary line
  • Access to watch team run out from the race
  • Supporter pack in their club of support to the value of $100.

14. The total prize pool is valued at $2,000.

15. Five (5) prizes will be awarded in total. There is a limit of one (1) prize per Eligible Entrant.

16. If for any reason a winner does not take the prize or any part of the prize at the time stipulated by the Promoter, then the prize or that part of the prize cannot be transferred, exchanged or redeemed for cash.

17. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:

(a)        To disqualify any Eligible Entrant; or

(b)       Subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

19. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the AFL (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion or accepting or using the prize.

21. The Promoter reserves the right to request that the winner provide proof of identity prior to awarding the prize. Identification considered suitable for verification is at the discretion of the Promoter. Prize winner may be required to sign any form required by the Promoter including without limitation a legal release and indemnity form or a declaration confirming their eligibility to accept the prize.

22. In the event that a winner is unable to be contacted, and all methods of communication are unsuccessful, or a winner does not respond to the Promoter’s initial communications within three (3) months, a judgement for any unclaimed prizes may take place 01/08/2018, three (3) months from last judgement at the same time and place as the original judgement, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing by email on the day of the selection.  The prize remains the property of the Promoter until claimed by the prize winner.

23. Once prizes have left the Promoter's premises, the Promoter and their associated agencies take no responsibility for prizes damaged, delayed or lost in transit.

24. Should an Eligible Entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

25. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this competition, or for any technical error that may occur in the course of the administration of this competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

26. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

27. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition any changes are subject to State Regulations.

28. Eligible Entrants consent to the Promoter using the Eligible Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

29. Prizes and participation in the competition are subject to any conditions imposed by the supplier or organiser of the prizes, as applicable.

30. If due to any reason whatsoever the Promoter becomes aware after an Eligible Entrant has won the prize that the Eligible Entrant has not complied with these terms, that Eligible Entrant will have no entitlement to the prize, even if the Promoter has announced him/her as the winner and that Eligible Entrant will be required, at the direction of the Promoter, to return, refund or otherwise make restitution of the prize.

31. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, Eligible Entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

32. Each Eligible Entrant must ensure that any other person whose details have been provided by the Eligible Entrant to the Promoter for the purposes of the Eligible Entrant’s participation in this competition has given their implied or express consent for their details to be provided to the Promoter and any of its related companies and to be contacted by the Promoter or any of its related companies in relation to this competition.

33. Eligible Entrants acknowledge that the promotion is in no way sponsored, endorsed or administered by or associated with Facebook, Twitter, Pinterest, Instagram or any other social media platform whatsoever. Any information provided as part of the competition is provided to the Promoter and not to the relevant social media platform. Entry into the competition is deemed acceptance of the terms and conditions of any relevant social media platform’s terms and conditions including but not limited to Facebook’s terms and conditions of use and related rules on www.facebook.com. Eligible Entrants completely release any relevant social media platform, including but not limited to Facebook, from any and all liability in connection with this competition.

34. Unless the contrary intention appears, a reference in these terms or in any advertisement relating to this competition, to Australian dollars, dollars, AUD$ or $ is a reference to the lawful currency of Australia.  All references to dollar amounts are inclusive of goods and services tax (GST).

35. All entries and materials submitted to the Promoter in connection with this competition (in any form including without limitation in hard copy or electronic form) become and remain the property of the Promoter and each Eligible Entrant warrants it has the right to transfer these things to the Promoter.   The Promoter may use such entries and materials and any intellectual property rights subsisting in them in any medium and in any manner it sees fit, including without limitation, by reproducing, modifying or adapting such entries and materials. The Promoter may collect Eligible Entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the Eligible Entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each Eligible Entrant also agrees that the Promoter, the Promoter's employees, related companies and agents, including but not limited to the AFL, may use this information, in any media for future promotional purposes, marketing, publicity, research and profiling purposes without any further reference, payment or other compensation to the Eligible Entrant, including sending the Eligible Entrant electronic messages and telephoning the Eligible Entrant.

36. All personal information you provide will be used by the AFL in accordance with our Privacy Policy available at www.afl.com.au/privacy and may be disclosed by the AFL in accordance with the AFL’s Privacy Policy (including for promotional and marketing purposes).  By providing your personal information, you agree to such use by the AFL.

37. The competition is governed exclusively by the laws of Australia.

38. The Promoter is Australian Football League (ABN 97 489 912 318), 140 Harbour Esplanade, Docklands, 3008, (03) 9643 1999.    Any reference to AFL refers to the Australian Football League (ABN 97 489 912 318).
