2018 Terms and Conditions

MEMBERSHIP/ACCESS ENTITLEMENTS

All 2018 AFL Memberships are subject to the following terms and conditions.

1. Purchase of Membership

If you are successful in your AFL Membership application, the AFL will send you an email confirmation within 7 working days. A 2018 membership card and/or package will be sent by mail prior to the commencement of the 2018 pre-season competition if your application is received prior to Wednesday January 31, 2018. After this date, membership cards and/or packages should be received approximately 14 days after the date on which the AFL receives your application.

2018 Membership renewal applications received after Wednesday January 31, 2018 will be subject to a late fee of $25 for Adults and $10 for Juniors.

The AFL reserves its right to not accept a Membership application at any time in its absolute discretion.

2. Term of Membership

Subject to the following terms and conditions, your AFL Membership benefits will be available to you from the date of your first Membership payment to Wednesday October 31, 2018.

3.   Access Entitlements

3.1   2018 NAB Challenge: 2018 JLT Community Series (Preseason competition): All AFL Members will have access* to all matches during the 2018 JLT Community Series competition.

3.2   2018 Toyota AFL Premiership Season: Except where stated otherwise, all Members will have access* to up to 40 matches in any combination at the MCG and Etihad Stadium throughout the Toyota AFL Premiership Season. Due to demand, the Collingwood v Essendon ANZAC Day match is classified as a ‘reserved seat ticket’ event. AFL Members wishing to attend this match will be required to pay for a reserved seat and general admission access will not be available.

3.3   2018 Toyota AFL Finals Series Weeks 1 and 2: Except where stated otherwise, all Members will have access* to matches scheduled at the MCG and Etihad Stadium in weeks 1 and 2 of the Toyota AFL Finals Series. The AFL makes no representation or guarantee that there will be any match scheduled at the MCG or Etihad Stadium in either of weeks 1 and 2 of the Toyota AFL Finals Series. Members will be provided with further information regarding Toyota AFL Finals Series tickets in August 2018.

3.4  2018 Toyota AFL Finals Series Week 3:  AFL Gold Members will have Access* to all Week 3 matches scheduled at the MCG and Etihad Stadium (and other venues, where their club of support is playing at those venues). AFL Silver Members will have Access^ to purchase a ticket to Week 3 matches scheduled at the MCG and Etihad Stadium and may purchase guest passes to Week 3 matches where the AFL makes them available.

3.5   2018 Toyota AFL Grand Final: Tickets to the 2018 Toyota AFL Grand Final will be made available to AFL Members in the following order of priority:

3.5.1   Priority Access^ to Gold Members who have nominated a club of support as part of their AFL Membership and is participating in the Grand Final (Grand Final Team Club Support).

3.5.2   Second Access^ to Gold Members who do not have a Grand Final Team Club Support (subject to tickets being available after the Priority Access period).

3.5.3   Third Access^ to Silver Members who have a Grand Final Team Club Support (subject to tickets being available after the Second Access period).

3.5.4   Fourth Access^ to Silver Members who do not have a Grand Final Team Club Support (subject to tickets being available after the Third Access period).

3.6   Cricket: Members will have access to International Cricket Test, Twenty20 and One Day International matches scheduled at the MCG (excluding Big Bash League matches). Tickets can be obtained only by reservation and are limited to one ticket per Member per match. Reservation fees apply. Additional guest passes may be purchased at the same price as tickets available to the public.

4.    Applicable Venues

AFL Membership access is limited to matches at the MCG and Etihad Stadium. Access to other venues will vary across clubs and will be communicated via membership.afl.com.au.

5.   General Stadium Rules

AFL Members must adhere to the AFL’s Conditions of Entry into an AFL Venue and must adhere to any further rules and restrictions imposed by the MCG and Etihad Stadium (or any other venue attended by the AFL Member). All AFL venues are smoke-free. Patrons are not permitted to bring alcohol into any venue and must adhere to strict restrictions placed on alcohol consumption in designated areas at all venues. Umbrellas are not permitted to be opened anywhere within viewing areas at any time on match day.

6.   Saving Seats in the AFL Reserve

AFL Members are not permitted to save seats for latecomers. Attendants are authorised to remove items used to save seats. AFL Members must respect the temporary reservation of a seat should a Member who has entered the ground wish to vacate their seat briefly.

7.   MCG Crossovers

Crossover access into the public section of the MCG is at the discretion of the MCC and subject to change on match day. Crossovers into the public section is available during International Cricket matches.

8. Guest Passes

The AFL may make Guest Passes available for sale to AFL Members. Guest Passes will be sold on a first-come, first served basis until sold out. AFL Members are advised to pre-purchase Guest Passes, particularly for high demand matches. Subject to availability, Guest Passes may be made available for sale at the gate on match day.

The standard limit on the number of Guest Passes is four per Member at the MCG and two per Member at Etihad Stadium for Toyota AFL Premiership Season matches, and one per Member at the MCG and at Etihad Stadium for Toyota AFL Finals Series matches (Weeks 1-3). The AFL reserves the right to vary the number of Guest Passes available to each Member at each venue as well as the total guest pass allocation. Once guest passes have been purchased, no refunds will apply except as required by law.

Guest Passes will not be available for the Collingwood v Essendon ANZAC Day match or the AFL Grand Final. Etihad Stadium Level 1 Guest Passes will not be available for matches featuring Essendon or Collingwood and further Guest Pass restrictions will be determined for high demand matches.

9.  AFL Membership Cards

AFL Members are required to carry their Membership card with them when attending a match, including when a reserved seat has been pre-purchased. AFL Members who do not carry their card with them when attending a match may be required to pay an entrance fee at the same price as an AFL Members Guest Pass.

9.1.  Lost or Stolen Memberships Cards

A Member who loses an AFL Membership card will be provided with a new card upon providing the AFL with a statutory declaration stating that the card has been misplaced and upon payment of a card replacement fee of $5. The card will be replaced at no cost upon provision of a police report detailing the theft.

10.  Transferability

AFL Membership cards and associated benefits are for personal use only and may not be transferred to another person under any circumstances. Lending an AFL Membership card, or in any other way transferring AFL Membership benefits to another person, is a breach of AFL Membership terms and conditions and penalties apply (including downgrade or cancellation of the offending person’s AFL Membership). Regular ID checks will be carried out at grounds and online sale website searches will be conducted to detect any breaches of this condition. The AFL Membership card remains the property of the Australian Football League.

11.  No Resale

AFL Membership cards, AFL Reserve tickets and Guest Passes may not, without the prior written consent of the AFL, be resold or offered for resale at a premium (including via online auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original purchaser or any subsequent bearer. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the bearer of the ticket may be refused admission. Penalties apply (including cancellation of any offending member’s AFL Membership without a refund).

Scalping warning: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties. The AFL Grand Final is a Declared Event under the provisions of the Major Sporting Events Act 2009 (Vic), a breach of which may be an indictable offence and allows your ticket to be cancelled.

12.  Club Support Packages

12.1. AFL Members may nominate a club of support as part of their AFL Membership application or renewal (Club Support Package). Your Club Support Package covers the cost of entry for your club’s home matches. Your club (or your club’s home venue(s)) will determine seating requirements and may require you to reserve a seat at an additional cost (either seasonally through your club of support or for individual matches through a nominated ticket agency).

12.2. Unless you advise otherwise in your Membership application or renewal, by nominating a club of support you are agreeing to your personal details being forwarded to the club so that it may contact you for club or commercial purposes, including fulfilment packs, upgrade products and finals access.

Members will not be able to change their nominated club of support after Friday, March 30, 2018, but may opt out of receiving that club’s communications at any time.

13.  Cancellation Policy 

The AFL reserves its right to cancel a member’s AFL Membership without a refund where that member is deemed by the AFL to have breached these terms and conditions (including where that member attempts to transfer or sell their AFL Membership and/or associated benefits).

14.  Variation to AFL Membership Terms and Conditions

The AFL may from time to time where reasonably necessary vary the terms and conditions of AFL Membership. The AFL will communicate any change to the terms and conditions of AFL Membership via the membership.afl.com.au. Members will have no claim against the AFL for any change made to the terms and conditions of AFL Membership.

15. AFL Member Code of Conduct

While barracking and supporting your club is a vital part of the game, offensive or aggressive behaviour (including yelling and swearing when dealing with AFL staff, agents or event staff) will not be tolerated. AFL Members who consume alcohol on a match day are to do so responsibly. Drunkenness will not be tolerated. AFL Members who breach the behaviour code of conduct may face penalties including cancellation of Membership without refund.

The AFL has a strong stance on vilification and has a zero-tolerance for members or supporters who engage in conduct which may reasonably be considered to incite hatred towards, contempt for, ridicule of or discrimination against a person or group of persons (including the opposition, opposition supporters, or umpires) on the ground of their race, religion, gender, colour, sexual preference, orientation or identity, or special ability or disability.

16.  Dress Standards

Dining rooms in the AFL Reserve at the MCG and Etihad Stadium maintain dress standards. The dress standard is neat casual - thongs, shorts and singlets are not permitted. Appropriate attire is also required in all seating areas. AFL Members who are not dressed appropriately will be denied entry.

17.  No Voting Rights

AFL Membership does not grant AFL members any voting rights.

18.  Members Privacy

All personal information will be used and may be disclosed, by the AFL (including for promotional and marketing purposes) in accordance with the AFL Privacy Policy available at www.afl.com.au/privacy.  By providing your personal information you agree to such use and disclosure by the AFL and confirm you have read and agree to be bound by the AFL Privacy Policy.

CLASSIFICATIONS

All 2018 AFL Memberships are subject to the following terms and conditions

19.      MEMBERSHIP TYPES 

19.1.   Gold Membership: Gold Membership is the highest level of AFL Membership, capped at 31,000 Members and available for purchase only to existing Gold Members. The AFL will offer Gold Membership to selected Silver Members for an upgrade to Gold Membership each season, with the number of offers dependent on the retention of current Gold Members. Gold members must renew their membership prior to Thursday, 31 May 2018  to maintain their Gold membership entitlements for 2018 season.

19.2.   Silver Membership: Silver Membership is available to all current AFL Members and, subject to availability, members of the general public seeking to purchase AFL Silver Membership for the first time. New Silver Memberships are subject to a once off joining fee.

19.3. Bronze Membership: Bronze Membership is available to all current AFL Members and, subject to availability, members of the general public.

19.3.1. Access* up to 10 matches at the MCG through the 2018 Toyota AFL Premiership Season. Plus access* to the 2018 Toyota AFL Finals Series weeks 1 -2 at the MCG at Guest Pass Price, if guest passes are available. 

19.4.   Family: To be eligible for a family discount, there must be two full paying Gold, Silver or Bronze adult members (adult members with no concessions or discounted members) and one full fee-paying junior or student member and reside at the same residential address. Any additional juniors will be provided with a complimentary Membership upon payment of the new member fee if joining AFL Membership in 2018. No more than four juniors can be linked to one family for the purposes of this discount. The junior or student with the highest value Membership type will be required to pay the annual Membership fee.

19.5. Junior 

To be eligible for a Junior Membership, the applicant must be over the age of 6 and under the age of 17 as at January 1, 2018. Juniors aged 6 and under at January 1, 2018 can purchase an AFL Under 7 Membership. Juniors aged 5 and under do not require an AFL Membership, however they cannot access a seat at matches unless there are seats available in the AFL Reserve which have not been reserved. Only children aged 3 and under are entitled to access Toyota AFL Finals Series matches free of charge, however they must not occupy a seat.

19.6. Under 7
An Under 7 Membership is available for children under the age of 7 as at January 1, 2018. A one-off new member fee is payable on sign up and the membership will continue to be complimentary until the Under 7 member reaches Junior member statues (see point 18.5). Upon becoming an Under 7 Member, your child will be placed on the waiting list for Gold Membership and receive an annual Under 7 Membership, allowing them to purchase reserved seating in the AFL Reserve at the MCG and Etihad Stadium (subject to capacity). An Under 7 Membership provides access equivalent to an AFL Silver Membership, excluding club of support entitlement.

19.7. Country 
Gold Members living more than 180km (as determined in accordance with Australia Post postcode data) from the Melbourne CBD are eligible for Country concession. When first applying for country concession, you will need to supply a statutory declaration, together with proof of residency (for example, a copy of your driver’s licence) to verify your address. When renewing a country concession, Gold Members will be required to verify their country residential status each renewal period by submitting proof of residency with their renewal application. In all cases, PO Box addresses will not be accepted without supporting documentation.

19.8. Absentee
An Absentee Membership allows you to place your Membership on hold for a season (or multiple seasons if the annual fee for Absentee Membership is maintained) and allows you to return to the same Membership status and number when your circumstances change. Gold and Silver Members may obtain an Absentee Membership for an annual fee of $150 (inc GST) for adults and $75 (inc GST) for juniors and upon provision of a letter or email (accompanying your renewal application) which outlines your Absentee status. Gold Absentee Members are unable to change back to an access level membership after Thursday, May 31, 2018
.

CONCESSION

All 2018 AFL Memberships are subject to the following terms and conditions.

20. Concession Membership

Any member eligible for or considering a concession membership must provide a copy of their concession at the point of purchase. Please email a photograph or scanned copy of your valid concession through membership@afl.com.au.

Members who purchase a membership at the concession rate have until Thursday May 31, 2018 to provide proof of their concession or they will be automatically charged at the adult rate for 2018 season. 

20.1. Student Concession 

Student concession is available to students studying full-time in 2018 at an Australian Education Institution. Your Membership application/renewal form must be accompanied by a copy of your 2018 student card or a photocopy of a stamped, receipted 2018 enrolment form from your Australian Education Institution.

Student cards provided must have a visible and valid expiry date to be accepted. All enrolment forms must show full-time enrolment for both Semester 1 and 2 in 2018.

As a student, you may defer your payment until 31 March 2018. If you choose to do this, you will be unable to utilise any of your Membership benefits until payment is made. Please contact the AFL Membership Service Centre on 1300 722 515 should you wish to defer payment. Students who renew their Membership at the Adult rate will be required to lodge their student concession request by close of business on Thursday May 31, 2018 to obtain the appropriate refund. Refund requests received after this time will not be accepted.

Alternatively, members who purchase a membership at the concession rate have until Thursday May 31, 2018 to provide proof of their concession or they will be automatically charged at the adult rate for 2018 season. 

Students applying for concession membership after close of business Thursday May 31, 2018 must provide enrolment forms stating full-time status for both semesters 1 & 2. Student cards will not be accepted after this date.

20.2. Concession/Pensioner
Concession discounts apply to members holding the following pension/concession cards:

  • Centrelink
  • Department of Health and Community Services
  • Department of Community Services
  • Department of Veteran Affairs

A photocopy of your pension/concession card must accompany your 2018 renewal. Pension/concession cards must be valid for the duration of the 2018 Toyota AFL Premiership Season.
Dependents listed on the pension card are NOT eligible for a concession membership unless they hold their own pension/concession card. 

Concession/Pensioner who renew their Membership at the Adult rate will be required to lodge their concession request by close of business on Thursday May 31, 2018 to obtain the appropriate refund. Refund requests and proof of concession received after this time will not be accepted.

AFL ADVANCE EASY PAY

All 2018 AFL Memberships are subject to the following terms and conditions.

Payment of your AFL Membership fee may be made in one of two ways:

21. Full Payment: Your Membership fee can be paid via any one of the following methods: VISA, MasterCard, Australia Post Billpay, Cheque, Cash or EFTPOS.

21.1. Payment Plan: Except where otherwise stated, your Membership payments via a payment plan as follows:

21.2.    AFL Advance Easy Pay monthly payments will be deducted in 10 equal instalments on the 28th of each month, beginning on November 28, 2017 via a nominated VISA or MasterCard only.

21.2.1.  By signing with the AFL Advance Easy Pay payment plan you authorise the AFL to arrange a debit of funds from your nominated credit card in amounts and at intervals as advised.

21.2.3.    All members on the AFL Advance Easy Pay payment plan are automatically included into an Auto Renewal Agreement, facilitating automatic rollover of your memberships from year to year.

21.2.4.   Members can only opt out of the AFL Advance payment plan after the last instalment and prior to the first instalment for the following season by notifying the AFL either in writing or via email to membership@afl.com.au. All outstanding payments must be complete at time of opting out.

21.2.5.   Members will be given at least 14 days’ notice in writing of changes in the new amount of their next season's membership and to the terms of AFL Advance Easy Pay payment plan agreement.

21.2.6.    The first instalment will be withdrawn on November 28, 2017, with further payments on the 28th of each following month. If any payment fails to transfer between institutions on the 28th, further attempts will be made to attempt to clear the fund transfer. If the 28th of the month falls on a weekend, the payment will be withdrawn on the next business day.

21.2.7.    Members applying for the AFL Advance Easy Pay payment plan after the first scheduled payment will have the number of required payments deducted to bring them up to date with the schedule and then subsequent payments at each specified date.

21.2.8.   If your debit is returned or dishonoured by your financial institution, a letter will be sent requesting immediate payment. Any fees levied to you by your financial institution will be payable to you.

21.2.9.    The AFL may suspend or cancel your membership if, on two consecutive occasions, payment is dishonoured by your financial institution.

21.2.10.  It is your responsibility to ensure that: (a) the account details you have provided are correct, including notification should the expiry date change within the 10-month program; (b) you have sufficient clear funds available in the nominated account on the scheduled drawing date.

21.2.11.  If your Membership is suspended or cancelled, you will not be able to gain access to any matches during the Premiership Season or the Toyota AFL Finals Series.

21.2.12.  If you believe that a withdrawal has been initiated incorrectly, please contact the AFL Membership Service Centre on 1300 722 515. You will receive a full refund of the withdrawal amount if we cannot substantiate the reason for drawing.

21.2.13. All AFL Advance Easy Pay monthly instalments are subject to $10 administration fee and will be charged within 3 working days of the initial payment on November 28, 2017. If the Member signs up after November 28 2017, the $10 administration fee will be charged within 3 working days of the next scheduled instalment. If the administration fee payment fails to transfer between institutions, further attempts will be made to attempt to clear the fund transfer. 

22.  GST and Levies

Except where expressly noted, all prices include GST and the $12 MCG levy (which applies to adults, pensioners and students).

* Access to matches is not guaranteed. Access is subject to capacity and the AFL recommends that Members reserve a seat in order to guarantee entry, particularly at high demand matches. AFL Members will be required to pay additional fees and charges when reserving a seat and ticket agencies may charge a booking fee which is also to be covered by the Member. For any match other than the Collingwood v Essendon ANZAC Day match, access may be gained to designated unreserved seating on a first-come, first served basis subject to availability and Members can upgrade to a reserved seat at the venue for an additional fee subject to availability.

^ Access to purchase tickets at an additional cost. Availability is subject to capacity and is not guaranteed. Ticket agencies may charge a booking fee upon purchase of tickets, with such fees to be covered by the Member.

 

UNDER 7 FOOTBALL EXPERIENCE

AFL MEMBERSHIP UNDER 7 JUNIOR MEMBER ULTIMATE FOOTBALL EXPERIENCE 

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Conditions of Entry. Participation in this competition is deemed acceptance of these Terms and Conditions.

2. Entry is open to Australian residents who reside in Victoria and are an ‘AFL Under 7 Member’ (“Eligible Entrants”). All entrants must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this competition.

3. Employees (and their immediate families) of the Promoter, participating outlets and the agencies associated with this promotion are ineligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse child or step-child (whether natural or by adoption), parent, step-parent.

4. Competition commences on 01/01/18 at 12:01am AEDST and closes 30/04/18 at 11:59pm AEST (the “Competition Period”).

5. To enter this competition, Eligible Entrants must during the Competition Period complete and submit a drawing of their ’favourite footy moment’, by posting their drawing to AFL, GPO Box 5275, Melbourne VIC 3001, detailing their full name, email address, contact phone number and team of support.

6. The Promoter reserves the right, at any time, to invalidate any entries (and entrants who submit or cause those entries to be submitted) which it reasonably suspects have been submitted: (a) using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information; (b) through the use of multiple identities, email addresses or accounts; and/or (c) in any way in contravention of these Terms and Conditions

7. Incomplete, illegible or incorrect entries, or those which contain offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, will be deemed invalid.

8. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.

9. The Promoter reserves the right, at any time during, or after the closing date of the competition, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

10.  Entries are deemed to be received at the time of receipt into the Promoter’s competition database and NOT at the time of completion by the Eligible Entrant. Any cost associated with entering the competition is the Eligible Entrant’s responsibility.

11. The judging will take place at AFL House, 140 Harbour Esplanade, 3008 on 01/05/18 at 11:00am. The prize winners will be notified via phone call and/or email within two (2) days of the selection to organise the claiming of their prize. The Judges' decision is final and no correspondence will be entered into. The winners’ names will be published on the AFL Membership Facebook page and membership.afl.com.au from the day that the prize winner is selected.

12. This is a contest of skill, judged on criteria set by the AFL. Chance will not play a role in determining the Competition winner.

13. The most creative drawing will win one (1) x Ultimate Football Experience valued at approximately $400.  The prize includes:

  • Free reserved seat upgrade for the winner plus three (3) guests to an  AFL match of their choice at Etihad Stadium during the 2018 AFL Premiership Season
  • Complimentary dining in the AFL Members Lounge in Victory Room at Etihad Stadium for the winner plus three (3) guests to the same match chosen in the point above in 2018 AFL Premiership Season
  • Tour of AFL House at a time determined by the AFL
  • Photo with the Premiership Cup
  • Access to the post-match press conference room
  • Watch teams warm up from the boundary line
  • Access to watch team run out from the race
  • Supporter pack in their club of support to the value of $100.

14. The total prize pool is valued at $2,000.

15. Five (5) prizes will be awarded in total. There is a limit of one (1) prize per Eligible Entrant.

16. If for any reason a winner does not take the prize or any part of the prize at the time stipulated by the Promoter, then the prize or that part of the prize cannot be transferred, exchanged or redeemed for cash.

17. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:

(a)        To disqualify any Eligible Entrant; or

(b)       Subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

19. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the AFL (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion or accepting or using the prize.

21. The Promoter reserves the right to request that the winner provide proof of identity prior to awarding the prize. Identification considered suitable for verification is at the discretion of the Promoter. Prize winner may be required to sign any form required by the Promoter including without limitation a legal release and indemnity form or a declaration confirming their eligibility to accept the prize.

22. In the event that a winner is unable to be contacted, and all methods of communication are unsuccessful, or a winner does not respond to the Promoter’s initial communications within three (3) months, a judgement for any unclaimed prizes may take place 01/08/2018, three (3) months from last judgement at the same time and place as the original judgement, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing by email on the day of the selection.  The prize remains the property of the Promoter until claimed by the prize winner.

23. Once prizes have left the Promoter's premises, the Promoter and their associated agencies take no responsibility for prizes damaged, delayed or lost in transit.

24. Should an Eligible Entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

25. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this competition, or for any technical error that may occur in the course of the administration of this competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

26. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

27. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition any changes are subject to State Regulations.

28. Eligible Entrants consent to the Promoter using the Eligible Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

29. Prizes and participation in the competition are subject to any conditions imposed by the supplier or organiser of the prizes, as applicable.

30. If due to any reason whatsoever the Promoter becomes aware after an Eligible Entrant has won the prize that the Eligible Entrant has not complied with these terms, that Eligible Entrant will have no entitlement to the prize, even if the Promoter has announced him/her as the winner and that Eligible Entrant will be required, at the direction of the Promoter, to return, refund or otherwise make restitution of the prize.

31. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, Eligible Entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

32. Each Eligible Entrant must ensure that any other person whose details have been provided by the Eligible Entrant to the Promoter for the purposes of the Eligible Entrant’s participation in this competition has given their implied or express consent for their details to be provided to the Promoter and any of its related companies and to be contacted by the Promoter or any of its related companies in relation to this competition.

33. Eligible Entrants acknowledge that the promotion is in no way sponsored, endorsed or administered by or associated with Facebook, Twitter, Pinterest, Instagram or any other social media platform whatsoever. Any information provided as part of the competition is provided to the Promoter and not to the relevant social media platform. Entry into the competition is deemed acceptance of the terms and conditions of any relevant social media platform’s terms and conditions including but not limited to Facebook’s terms and conditions of use and related rules on www.facebook.com. Eligible Entrants completely release any relevant social media platform, including but not limited to Facebook, from any and all liability in connection with this competition.

34. Unless the contrary intention appears, a reference in these terms or in any advertisement relating to this competition, to Australian dollars, dollars, AUD$ or $ is a reference to the lawful currency of Australia.  All references to dollar amounts are inclusive of goods and services tax (GST).

35. All entries and materials submitted to the Promoter in connection with this competition (in any form including without limitation in hard copy or electronic form) become and remain the property of the Promoter and each Eligible Entrant warrants it has the right to transfer these things to the Promoter.   The Promoter may use such entries and materials and any intellectual property rights subsisting in them in any medium and in any manner it sees fit, including without limitation, by reproducing, modifying or adapting such entries and materials. The Promoter may collect Eligible Entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the Eligible Entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each Eligible Entrant also agrees that the Promoter, the Promoter's employees, related companies and agents, including but not limited to the AFL, may use this information, in any media for future promotional purposes, marketing, publicity, research and profiling purposes without any further reference, payment or other compensation to the Eligible Entrant, including sending the Eligible Entrant electronic messages and telephoning the Eligible Entrant.

36. All personal information you provide will be used by the AFL in accordance with our Privacy Policy available at www.afl.com.au/privacy and may be disclosed by the AFL in accordance with the AFL’s Privacy Policy (including for promotional and marketing purposes).  By providing your personal information, you agree to such use by the AFL.

37. The competition is governed exclusively by the laws of Australia.

TERMS AND CONDITIONS

 

1. This document contains the terms and conditions of entry ("these Terms") into the AFL Members - AFL Footy Tipping 2018 Competition ("Promotion"). Entry into this Promotion is deemed acceptance of these Terms.

2. The Promoter is Australian Football League (“AFL”) ABN 97 489 912 318 of 140 Harbour Esplanade, Docklands 3008 ("Promoter").

3. The Promotion will be open from 5:00 pm on Monday 19 March 2018 and will continue until the starting time of the last match of the Home and Away Season, which will be no later than 11:59 pm on Monday, 27 August 2018 ("Promotion Period").  All times in these Terms are expressed as the local time in Melbourne, Victoria.

4. Entry is open to AFL Members, who are residents of Australia, and have fully paid or are on an AFL Advance Pay Option for a 2018 Gold, Silver, Bronze, Junior, Under 7 and Absentee membership excluding employees of the Promoter and other agencies, firms or companies associated with this Promotion, and their immediate families. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

DEFINITIONS

5. In these Terms, the following meanings apply in addition to terms which are defined elsewhere in these Terms unless the contrary intention appears:

 “Comp” (Competition) means a private or public league for entrants to join as individuals.

"Cumulative Margin" means, in respect of an Entrant, the sum of the Margin Differences for all Rounds as at a particular date.

“Draw” means an even score at the conclusion of a Match.

"Entrant" means a person who is eligible to participate in and has submitted an entry into this Promotion in accordance with these Terms.

"Judging Location" means the premises located at AFL House, 140 Harbour Esplanade, Docklands, Victoria 3008.

“Leaderboard” means the Promotion’s overall ladder of Entrant rankings.

"Margin Difference" in respect of a Margin Game means, for an Entrant that:

a. has correctly tipped a winning team, the difference between the margin nominated by the Entrant for that Match and the actual margin for that Match;

b. has tipped the losing team, the aggregate of the margin nominated by the Entrant for that Match and the actual margin for that Match (e.g. if entrant nominates a margin of 14, and their tipped team loses by 20 points, their ‘Margin Difference’ for the Match will be 34); and

c. has not submitted a tip for that Margin Game, the actual margin for that Margin Game as determined by the Promoter.

"Margin Game" means the first Match of each Round in the Home and Away Season as determined by the Promoter.

"Match" means a single game of AFL football, which is conducted as part of the Home and Away Season;

"Ranking" means where an Entrant ranks or is placed overall in the Promotion.

"Round" means one of the 23 rounds consisting of Matches conducted during the Home and Away Season.

Home and Away Season” means the 23 home and away rounds of Matches in the 2018 Toyota AFL Premiership Season.

"Score" means the number of points allocated to an Entrant for the correct tipping of winning teams in each Round in accordance with these Terms.

"Tipping Website" means the website of the Promoter at tipping.afl.com.au, accessible on the internet through the World Wide Web or via mobile internet enabled devices.

ENTRY CONDITIONS

6. To register for the Promotion Entrants must during the Promotion Period:

  1. register their details via the on-line registration form located on the Tipping Website and provide all required information;
  2. go into the ‘comps’ tab, click on ‘join a comp’, then enter the code JRX6JLED; and
  3. opt-in to subscribe to AFL email communications including the “AFL Newsletter” unless previously subscribed (in which case the subscription will carry over) in accordance with the Promoter’s Privacy Policy.

7. The Promoter reserves the right not to accept a registration for any Entrant or to disqualify an Entrant if the Promoter considers that the registration contains anything defamatory or is otherwise inappropriate.  There is a limit of one entry per person and any person submitting more than one (1) entry will not be eligible to win a prize in the Promotion.

8. An Entrant may only register as an individual.

9. Entrants will have the opportunity, in respect of each Match in each Round of the Home and Away Season, to tip by:

 a. selecting a team that the Entrant expects will win the Match (a Draw cannot be selected); and

b. submitting those selections via the Tipping Website (selections for each Match must be submitted before the scheduled start time of the relevant Match).  Each Entrant can only provide one set of tips and those tips can apply to any Comp he/she is involved.

c. An Entrant may make or change a tip for a given Match at any time prior to the scheduled starting time of that Match, subject to these Terms.

d. Entrants will have the opportunity, in respect of the first Match in each Round of the Home and Away Season, to tip by selecting the team that the Entrant expects to win and also including the margin by which they expect that their selected team’s score will beat the opponent team’s score for the Margin Game. If the team the Entrant tips scores greater than or equal to the opposition score, their tip is considered successful.

FAILURE TO TIP

12. If an Entrant:

 a. does not submit a tip for a given Match in a Round, then the Entrant's tip for that Match will be deemed to be for the team                         determined, in the Promoter's sole discretion, to be the "away team"; or

b. does not submit a tip for Matches in an entire Round, the Entrant's tips for that Round will be deemed to be those of the teams determined, in the Promoter's sole discretion, to be the "away teams" up to a maximum of five correct tips for that Round; or

c. enters the Promotion after the commencement of the first Round of the Home and Away Season, then the Entrant's tips for those Matches that have been completed will be deemed to be those of the teams determined to be the "away teams" to a maximum of five (5) correct tips for each such Round.

SCORING

13. Subject to the rules relating to failure to tip in Clause 12, Entrants will be allocated one (1) point for each correctly selected winning team for a Match.

14. In the event of a Match in a given Round being drawn, cancelled, abandoned, not completed or not played for any reason and the AFL does not officially declare a result within one (1) day of the original scheduled date of the Match, it is treated as a win for both teams competing in that Match.

OVERALL RANKING
15. Throughout the Home and Away Seaons, the Promoter will maintain a leaderboard 
which ranks the Entrants from highest to lowest based on their Scores. To determine the ranking of two or more Entrants that have an equal Score, the Entrant with the lower Cumulative Margin will rank higher than other Entrants with corresponding equal Scores.

MAJOR PRIZES

16. The Entrant who has the highest Ranking at the end of the last Round (Round 23) of the Home and Away Season will win the First Prize.   The Entrant who has the second highest Ranking at the end of the last Round (Round 23) of the Home and Away Season will win the Second Prize. The Entrant who has the third highest Ranking at the end of the last Round (Round 23) of the Home and Away Season will win the Third Prize.

17. There are two or more Entrants with equal highest Ranking, then the higher prize will be awarded to the Entrant who submitted their last tip for the last Round of the Home and Away Season first.

18. The First Prize is one (1) double pass to the 2018 Toyota Grand Final AFL Members Dining Room Experience valued at up to $1200 and includes two (2) reserved seats (as selected by the Promoter) to the 2018 Toyota AFL Grand Final to be held on Saturday, 29 September 2018.

19. The Second Prize is valued at up to $610 and consists of (a) one (1) 2019 AFL Membership up to the value of the winner’s 2018 AFL Membership; and (b) one (1) 2019 double pass for a la carte dining valued at $210 for an AFL match at the MCG during the 2019 Toyota AFL Premiership Season chosen by the winner (as provided by the Promoter and subject to availability), excluding ANZAC Day (25 April 2019) and Queen’s Birthday (11 June 2019). 

20. The following additional conditions apply to the First Prize and the Second Prize – (a) if a minor participates in any part of the prize he/she must be accompanied by a parent or legal guardian over the age of 18 years; (b) if the winner does not take the prize, or any part of the prize, during the time period stipulated, then the prize, or that part of the prize not taken, is forfeited and cash will not be awarded in lieu of the prize; (c) all ancillary and travel costs are the winner’s and/or companion’s responsibility – no travel and ancillary costs form part of the prize; (d) all tickets are valid for the date as indicated on the tickets and are subject to the conditions stipulated by the provider of the tickets; and (e) the winner and any companion will be required to abide by any dress codes and/or instructions with respect to the events and behave responsibly including the responsible consumption of alcohol, no prohibited drugs or medication, no aggressive or offensive behaviour, or behaviour which may diminish the enjoyment of any of the events by any other person or behaviour that may diminish the good name or reputation of the Promoter and the Promoter may in its absolute discretion cancel a prize or otherwise cease to provide any benefit of a prize to a winner and/or companion if the winner, and/or companion in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate (or of the business of the Promoter or any of its related bodies corporate), is contrary to law or is otherwise inappropriate.

21. The Third Prize is a $200 Shop AFL voucher valued at up to $200.  The Third prize is subject to the terms and conditions of the voucher that can be found at https://shop.afl.com.au/.

22. The winners of the First Prize, Second Prize and Third Prize will be determined at the Judging Location at 5:00 pm on 28 August 2018.

23. The First Prize, Second Prize and Third Prize are valued at a total of $2220 (inc GST).

24. The winners of First Prize, Second Prize and Third Prize will be contacted in writing within two (2) days of the date of being judged a winner, and their name will be published on http://tipping.afl.com.au on 31 August 2018.

25. In the event that the First Prize is not claimed by 2:00 pm on 20 September 2018, the prize will be awarded to the Entrant who, would be the winner had the original winner been excluded from winning. This prize winner will be contacted in writing within two (2) days and their name published on http://tipping.afl.com.au on 22 September 2018.  The Second Prize and Third Prize winners will be adjusted as determined by the Promoter in the event the First Prize is not claimed.

MINORS

26. If an Entrant is under 18 years of age, they must have their parent or guardian's consent to enter the Promotion. The Promoter reserves the right to request this consent in writing. If consent in writing is requested, the winner’s nominated parent/legal guardian will be required to include the words "in consideration of AFL agreeing to admit the Entrant into this Promotion, [name of Parent or Guardian] agrees to be bound by the terms of entry into the Promotion" in such written consent.

27. If a prize winner is under the age of 18 years of age, the prize will be awarded to the winner’s nominated parent or legal guardian on behalf of the winner.

28.Minors may use prizes (where prizes are available for use by a minor), but they must have consent from their parent or legal guardian (which the Promoter may request in writing).

GENERAL

29. If so requested by the Promoter, all prize winners (and their parents or legal guardians if they are under 18 years of age) are required to sign a release and indemnity form in favour of the Promoter and return the document to the Promoter prior to taking their prizes.

30. The Promoter reserves the right, at any time, to verify the validity of entries/tips/registrations and Entrants (including an Entrant’s AFL Membership, identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms or who tampers with the entry/registration/tipping process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

31. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.

32. If for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.

33. The total prize pool for this Promotion is valued at up to $2220 (inc GST).  All prices and values in these Terms are stated in Australian dollars and are inclusive of GST.

34. Unless expressly stated otherwise, the winner of a prize in this Promotion is not excluded from winning another prize as part of this Promotion. All Entrants will be considered in the judging for prizes in this Promotion whether or not they have won another prize in this Promotion.

35. Prizes are not transferable or exchangeable and cheques will be not negotiable.

36.Judging of all prizes will be conducted by a representative of the Promoter.

37. The Promoter’s decision for all prizes in this Promotion is final and binding and no correspondence will be entered into.
38. Incomplete, indecipherable and incorrect entries/registrations/tips or entries/registrations/tips containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.

39. It is a condition of taking a prize that the winner must, if requested to do so by the Promoter, sign and return documents relating to their eligibility to enter (including ownership of entry), statement of compliance with relevant terms and conditions and/or a release of the Promoter's liability in taking prizes.

40. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

41. The Promoter accepts no responsibility for any entries, registrations or tips not received for any reason during the Promotion. Registrations, entries and tips will be deemed to be accepted at the time of receipt and not at the time of transmission. No responsibility will be taken for lost, late or misdirected registrations, tips or entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.

42. If the Promoter is unable to provide a winner with the nominated prize, the Promoter reserves the right to supply an alternative prize of the same monetary value, subject to any written directions given by State gaming departments.

43. Any Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.

44. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

45. The Promoter reserves the right to disqualify registrations, entries and/or tips in the event of non-compliance with these Terms. Notwithstanding the Promoter's rights under these Terms to not accept or to subsequently disqualify a Entrant, the Promoter will not be liable for any legal action arising out of any Entrant’s name being defamatory, inappropriate, in breach of any third party's rights, or in breach of any law, and any Entrant forming part of that name must indemnify the Promoter, its agents, contractors and related companies from any legal action, claim or dispute arising directly or indirectly from the Entrant’s name being defamatory, inappropriate, in breach of any third party's rights, or in breach of any law.

46. To the extent permitted by law, the Promoter and its agencies associated with this Promotion are not liable and do not accept responsibility for:

a. an Entrant's entry or tips not being received or which are received and subsequently corrupted or rejected by a server of the Tipping Website;

b. any private or public tipping competition which uses or relies upon the Tipping Website in any way as a means for collecting and disbursing data, or for conducting a tipping competition;

c. any lost, misdirected or corrupt registrations, entries, tips or emails whether to or from the Tipping Website or otherwise; and/or

d. any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained:

i. in connection with an Entrant’s participation in the Promotion or the taking of a place, except that which cannot be excluded by law; and/or

ii. relating to the conduct of the Promotion however caused, including failure of the Tipping Website or incorrect or corrupt data supplied by the Promoter to Entrant.

47. Information about Entrants is used by the Promoter to assess and process registration in the Promotion. If an Entrant does not provide the required information, the Promoter cannot process the registration. All registrations/entries become the property of the Promoter and will be entered into a database. Information emanating from the Entrant's participation in the Promotion is used by the Promoter and its agencies, contractors and service providers associated with this Promotion for the determination of winners and distribution of prizes, if any, awarded to an Entrant. Entry is conditional on providing this information. Entrants consent to publishing their name and accumulated points total in the results section of the Tipping Website and for their personal information to be disclosed to State and Territory lottery departments, as required under the relevant lottery legislation. The Promoter will not be held responsible for any loss of reputation, status or otherwise in connection with an Entrant's tipping selections and consequential results. The Promoter will also use and handle personal information (“PI”) as set out in its privacy policy, which can be viewed at www.afl.com.au/privacy (“Promoter’s Privacy Policy”). In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or contacting the Entrant. The Privacy Policy also contains information about how Entrants may opt out, access, update or correct their personal information, how Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.

48. By participating in this Promotion, each Entrant agrees and acknowledges that:

a. they may be contacted by the Promoter to provide comments about the Promotion and the Promoter (or an agent of the Promoter) may take photos of them;

b. the Promoter may use such comments or photos (the "Materials") for the Promoter's future promotional and marketing purposes without further reference or compensation to them;

c. the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at anytime, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;

d. they acknowledge that the Promoter retains all right, title and interest, including copyright, in the Materials and, by participating in the Promotion, they assign to the Promoter on creation of the Materials all right, title and interest which might, but for these Terms, vest in them;

e. they unconditionally and irrevocably consents to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");

f. they waive all Moral Rights in the Materials that arise outside Australia; and

g. they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.

49. Any cost associated with participating in the Promotion (including using a prize) and/or accessing the Tipping Website is the Entrant’s responsibility.

50. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including but not limited to: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry, registration, tip or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) taking and/or use of a prize.

52. The Promoter accepts no responsibility for any tax liabilities that may arise from winning the prize.

53. Once prizes have left the Promoter's premises, the Promoter and their associated agencies take no responsibility for prizes damaged, delayed or lost in transit.

54. The Promotion is governed exclusively by the laws of Australia.
